Terms of service
These terms govern your use of Sukhadcare as a client.
1. A warm welcome and what Sukhadcare does for you
The care behind the model: Seeking support takes courage. Sukhadcare was built to make finding the right therapist safe, private, and frictionless. We do not believe your need for help should require you to surrender your privacy to third-party trackers, brokers, or automated profiling systems.
What we do: Sukhadcare operates as an administrative matching bridge and technology intermediary. We verify independent practitioners, manage secure intake routing, facilitate your payments, and provide the secure video interface through which you and your therapist meet.
What we are not: We are an administrative platform, not a clinic, healthcare provider, or emergency service. We match you with independent professionals who hold their own clinical duty of care.
2. Crisis and emergency redirection
Important note on safety: Sukhadcare is not a crisis or emergency service. We cannot detect, monitor, or respond to all situations of risk, and you should never rely on this platform in an emergency. If you are in distress or danger, please contact Tele-MANAS (14416 / 1-800-891-4416) or your local emergency services directly, at any time. Where our intake identifies an explicit statement of acute risk, we will pause matching and show you these resources — but this is a redirection to others’ help, not a substitute for reaching out yourself.
3. Client anonymity, identity disclosure and data hand-off
Pre-match anonymity: Your intake needs-profile and identity remain strictly siloed. No therapist sees who you are while you review matches.
The moment anonymity ends: Anonymity ends at the exact moment you explicitly choose to begin a match with a selected practitioner. At that moment: your identity and contact details are disclosed to that one therapist only; the therapist becomes an independent data handler of that information under their own professional ethics and the DPDP Act, 2023; and any clinical notes, records, or session logs are held exclusively by your therapist under their professional record-keeping duty, never by Sukhadcare.
4. Age requirement and children’s data policy
Age eligibility: Sukhadcare is restricted to users aged 18 and older.
Children’s data prohibition: In strict compliance with Section 9 of the DPDP Act, 2023, the platform does not knowingly collect or process personal data of minors. We do not provide matching services for children, and no behavioural tracking or profiling of minors is permitted under any circumstance.
5. Payment terms, refunds and cancellations
Pricing and billing: Session fees are set independently by your therapist and processed securely via integrated third-party payment gateways.
Cancellations and refunds: If you cancel a session at least 24 hours prior to the scheduled start time, you are eligible for a full refund. Cancellations made within 24 hours are subject to the individual therapist’s stated cancellation policy. If a session fails to occur due to a platform-side technical failure, a full refund or re-scheduling credit will be issued automatically.
Dispute handling: Billing disputes or session grievances can be raised via your account dashboard for prompt administrative resolution.
6. Acceptable use and client conduct
You agree to provide accurate, truthful intake information.
You agree never to misuse the platform, harass therapists, or attempt to circumvent platform safety or payment mechanisms.
7. Account deletion, active treatment and data erasure
You may withdraw your consent and request erasure of your profile and pre-match intake data at any time under the DPDP Act. If you request erasure while actively engaged with a therapist or holding a booked session, your profile data will be disassociated immediately, but technical and billing records strictly necessary to satisfy statutory accounting obligations and complete active session wind-down will be retained for a limited, legally mandated period before final destruction.
8. Limitation of liability
Sukhadcare bears zero liability, exposure, or responsibility for any clinical outcome, professional malpractice, injury, or damages arising from sessions conducted with independent therapists. All clinical duty of care rests exclusively with the practitioner.
9. Governing law and dispute resolution
These terms are governed by the laws of India. Any legal dispute shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka. If your privacy grievance is not resolved satisfactorily via our in-app mechanism, you maintain the statutory right to escalate the matter directly to the Data Protection Board of India (DPBI) under the DPDP Act, 2023.
